제12조 입찰규격 또는 조건
Article 12 Bid Specifications or Conditions
①입찰자가 제안하는 모든 물품은 입찰설명서의 기술규격서의 조건에 부합하여야 하며, 해당 물품은 새것이고 사용된 적이 없는 정품으로서 모든 측면에서 사용목적에 적합하여야 하고, 최신 모델로서 정규적인 무역에서 거래되는 물품과 같거나 우월하여야 한다.
①All Goods proposed by the Bidder shall satisfy the technical specifications in the Bid Invitation, be new, unused, genuine products that are suitable for its intended purpose as set out in the Bid Documents in all respects, and be the most recent model with a quality equal to or better than products being traded through ordinary channels.
②입찰설명서에 명기된 특정 제작자의 상표나 카탈로그 번호는 조달청이 구매하고자 하는 물품의 형태 또는 품질을 나타낼 목적으로 기재한 것이며, 물품의 종류를 제한하고자 하는 것은 아니다. 다른 상표의 물품으로 입찰에 참여하더라도 입찰서류가 물품의 규격, 성능 등을 (설명서, 증빙서류 등으로) 명확하게 설명하고 있고, 입찰설명서에서 정한 물품의 규격에 적합하다면 그 입찰서류는 검토 및 평가의 대상에 포함될 수 있다.
②The trademark or catalogue number of the specific manufacturer included in the Bid Invitation is being stated for the purpose of explaining the form or quality of the Goods to be purchased by PPS, and not to restrict the type of the such Goods presented in the bidding process. Even if the Bidder participates in the bidding with any Goods bearing a different trademark, the Bid Documents may qualify for review and evaluation if the specifications, functions, etc. of the Goods are clearly explained (through explanatory materials or supporting documents) and such Goods conform to all of the other specifications set forth in the Bid Invitation.
