제14조 입찰보증금
Article 14 Bid Bond
①입찰자는 입찰금액의 100분의 5 이상에 해당하는 입찰보증금을 다음 각 호에 따라 제공하여야 한다. 입찰보증금은 입찰자를 대신하여 공급자가 제공할 수 있다. 입찰보증금이 아래 제출기한까지 제공되었는지 여부를 확인할 책임은 입찰자에게 있다.
①The Bidder shall provide a bid bond in an amount equal to 5% or more of the bid price (the "bid bond") in accordance with the following requirements. The Supplier may provide the bid bond on behalf of the Bidder. The Bidder shall be obligated to ensure that the bid bond is provided by the due date prescribed below.

②은행 발행 신용장 또는 보증서가 입찰보증금으로 제공된 경우 신용장 또는 보증서의 전신문에는 보증의 조건, 발행일, 보증금액, 지급조건, 만료일 등의 내용이 포함되어야 한다. 신용장 또는 보증서는 다음 각 호를 모두 충족하는 조건으로 발행된 것이어야 한다.
1.입찰자가 입찰설명서에 따른 조건을 준수하지 아니하였다는 취지가 지정은행에 통보되고 신용장 또는 보증서가 지정은행에게 제시되는 경우 지정은행은 즉시 지급할 의무가 있을 것
2.조달청은 지정은행으로부터 받은 보증금 상당 금액을 입찰설명서에서 정하는 바에 따라 즉시 몰수할 수 있을 것
②If any L/C or guarantee issued by a bank is provided as the bid bond, the cable advice of such L/C or a guarantee shall set forth the terms of guarantee, issue date, guarantee amount, payment terms and expiration date and shall satisfy all of the following:
1.shall obligate the designated bank to make an immediate payment upon notice of the Bidder’s failure to comply with the terms of the Bid Invitation and presentation of the L/C or guarantee to such bank; and,
2.shall allow PPS to immediately cash in the L/C or guarantee received by the designated bank, and confiscate the amount equivalent to the bid bond as set forth in the Bid Invitation.
③입찰보증금의 제공은 입찰설명서에서 달리 정하고 있는 경우를 제외하고, 입찰서류 유효기간 동안 유효하게 유지되어야 한다.
③The bid bond shall remain valid during the validity period of the Bid Documents unless the Bid Invitation provides otherwise.
④입찰설명서에 허용하고 있는 경우, 입찰자는 입찰보증금 납부를 확약하는 별지 제8호 서식에 따른 지급각서를 입찰서류와 함께 제출하여 입찰보증금의 납부에 갈음할 수 있다. 다만 다음 각 호의 어느 하나에 해당하는 경우에는 입찰보증금을 납부하여야 한다.

5.입찰공고일 이전 1년 이내에 「국가계약법시행령」 제76조제2항제2호가목의 사유로 입찰참가자격 제한을 받은 자(입찰참가자격 제한 중인 경우를 포함한다.)

④If specifically permitted under the Bid Invitation, Bidder may submit together with the Bid Documents a Memorandum of Payment, in the form set out in Appendix 8, whereby it will undertake to pay the bid bond in lieu of deposit of the bid bond. However, if any of the followings occurs, the bid bond shall be deposited.

3.Delinquencies of default or financial order under the Covenant for Credit Information Management

5.A person who is restricted on the qualification for participating in a tendering procedure (including cases where a person is in the period of restriction on the qualification for participating in a tendering procedure) for reasons prescribed in Article 76 (2) 2 (a) within one year before the date of public notice;

⑤입찰보증금 반환 요건을 충족하는 경우 입찰보증금은 이자 없이 즉시 반환된다.
⑤If all the conditions for the return of the bid bond are satisfied, the bid bond shall immediately be returned without interest.
⑥입찰보증금은 다음 각 호의 어느 하나에 해당될 경우 자동적으로 동결 또는 몰수된다.
1.낙찰자가 조달청이 정한 기한 내에 계약을 체결하지 아니한 때
2.입찰보증금의 유효기간이 만료되기 전 계약보증금을 납부하여야 하는 낙찰자가 조달청이 정한 기한 내에 계약보증금을 납부하지 아니한 때
⑥If any of the following events occur, the bid bond shall either be frozen or confiscated:
1.the Bidder who is selected as the successful Bidder fails to enter into the contract within a period designated by PPS; or
2.the successful Bidder, who is required to provide the performance bond before the expiration of the validity period of the bid bond, fails to deposit the performance bond within the period prescribed by PPS.
