제16조 입찰서류의 검토
Article 16 Review of the Bid Documents
①조달청은 입찰서류가 완전한지, 입찰서류에 계산적 오류가 있는지, 서명이 필요한 모든 서류들이 올바르게 서명되었는지, 입찰무효사유는 없는지 등을 검토한다. 조달청은 외부의 증거에 의지하지 않고 오로지 입찰서류 자체의 내용에 기초하여 입찰서류를 검토한다.
①PPS shall review whether (i) the Bid Documents are complete, (ii) there is any calculation error in the Bid Documents, (iii) all documents to be signed are validly signed, and (iv) any cause for bid invalidation exists. PPS shall review the Bid Documents based solely on the contents of the Bid Documents and not based on any outside evidences.
②조달청은 입찰서류상 사소한 불일치나 오타를 용인할 수 있다. 그러나 그 용인이 다른 입찰자의 비교 순위에 영향을 주게 되는 경우에는 그러하지 아니하다.
②PPS may tolerate any minor inconsistency or typos in the Bid Documents. However, such tolerance shall be limited to immaterial matters which will not affect the comparative rankings of other Bidders.
③입찰설명서의 요건에 부합하지 않는다고 결정된 입찰서류는 평가에서 제외된다.
③Any Bid Documents determined not to be in compliance with the requirements of the Bid Invitation shall be excluded from review and evaluation.
④조달청은 정당한 사유가 있는 경우 계약체결 전에 입찰서류 일부 또는 전부를 부적합 처리할 수 있고, 필요에 따라 재공고입찰을 실시할 수 있는 권리가 있다.
④If PPS has any reasonable grounds for doing so, PPS shall have the right to disqualify all or part of the Bid Documents, or hold a bid by second public notice as necessary, provided that PPS has yet to enter into the contract.
⑤조달청은 개찰이 개시된 후에는 입찰자로부터 추가서류를 수리하여서는 아니 된다. 다만, 다음 각 호의 어느 하나에 해당하는 서류는 예외로 한다.
1.입찰서류와 입찰보증금의 유효기간 연장에 관한 서류
2.정부에 유리하고, 입찰서류의 내용 및 가격순위에 영향을 주지 않는 추가서류로서 조달청이 요청한 해명자료
⑤Once the opening of the bids has been commenced, PPS shall not accept any additional documents from the Bidders; provided that, PPS may accept any of the following documents:
1.any documents relating to the extension of the expiration date of the Bid Documents and the bid bond; and
2.any additional supporting documents requested by PPS, which are advantageous to the Government containing clarifications, and do not affect the contents of the Bid Documents or the price ranking.
