제17조 입찰의 취소

Article 17 Cancellation of the Bid

①조달청에 의한 입찰 취소

1.낙찰자가 아직 선정되지 않은 경우, 입찰절차에 관련 법령의 규정이나 입찰설명서의 내용에 부합하지 않는 하자가 있고 그 하자로 인하여 입찰자의 정당한 이익을 해하거나 입찰의 공정성과 투명성에 영향을 미칠 우려가 있다고 인정되는 경우 조달청은 당해 입찰절차를 취소하거나 무효로 할 수 있다.

2.조달청은 다음 각 목의 어느 하나에 해당하는 경우 입찰을 취소할 수 있다.

a. 낙찰자가 선정되기 전 수요기관 등의 예산사정, 사업계획 변경 등 수요기관의 사정 변경이 있는 경우

b. 입찰자가 정상적으로 전자입찰서를 제출하였으나 KONEPS의 오류 등으로 인하여 공정한 입찰의 진행이 곤란하다고 판단될 경우

c. 기타 입찰 진행을 중단하여야 할 정당한 사유가 발생하였다고 조달청이 판단한 경우

3.입찰자는 제1호 및 제2호에 따른 조달청의 입찰 취소에 대하여 이의제기나 그로 인한 손해배상청구를 할 수 없다.

①Cancellation of the Bid by PPS

1.As long as the successful Bidder has not yet been selected, PPS may cancel or invalidate the relevant bid process if (i) there is a defect in the bidding process as a result of non-compliance with the relevant laws and regulations or the Bid Invitation, and (ii) it is determined that such defect may harm the valid interests of Bidders or affect the fairness and transparency of the bidding process.

2.PPS may cancel the bidding if

a. there is a change in the circumstances of the End User such as change in the budget or business plan of the End User, provided that the successful Bidder has not yet been selected;

b. although the Bidder has validly submitted its electronic bid, it is determined that fair bidding process is not possible due to an error in KONEPS, etc.;

c. PPS determines that justifiable cause for revocation of the bidding process exists.

3.No Bidder may raise any objection or seek damages PPS against for PPS’ cancellation of the bidding pursuant to subclauses 1. or 2. above.

②입찰자에 의한 입찰 취소

입찰자에 의한 입찰 취소에 관해서는 제9조 제5항에 따른다.

Bid cancellation by Bidders shall be proceeded in compliance with Article 9
