제18조 입찰무효
Article 18 Invalidation of the Bid
국가를 당사자로 하는 계약에 관한 법률 시행규칙 제44조 각 호의 사유 및 다음 각 호의 어느 하나에 해당하는 입찰은 무효로 한다.
1.A bid will be invalidated if any event stipulated in the Article 44 of the Enforcement Regulation of the Act on Contracts to which the State is a Party occurs or if:
1.동일 입찰에서 입찰자가 타인의 대리를 겸하거나 2인 이상을 대리하여 입찰한 경우
1.the same Bidder also represented another Bidder or a single representative represented two (2) or more Bidders in one bidding;
2.입찰금액 등을 포함하여 입찰서류의 중요한 부분이 불분명하거나 입찰서류의 정정 후 정정날인이나 서명을 누락한 경우
2.material part(s) of the Bid Documents, such as the bid price, are unclear or affixation of the seal or signature next to the correction made to the contents of the Bid Documents is missing;
3.담합하거나 타인의 경쟁참가를 방해한 경우 또는 관계 공무원의 공무집행을 방해한 경우
3.the Bidder colluded with other Bidders, interfered with any other person’s participation in the bidding process or obstructed the execution by the relevant civil servant of any of his or her public duties;
4.입찰자(법인의 경우 대표자를 말한다. 이하 같다)가 직접 입찰서류를 제출하지 아니하고 입찰대리인을 통하여 입찰서류를 제출할 경우 입찰참가자격등록신청서에 지정된 대리인이 아닌 자가 입찰서류를 제출한 경우 또는 대리권이 없는 자가 입찰서류를 제출한 경우
4.in case the Bidder (if the Bidder is a legal entity, the Bidder means the representative of the legal entity, hereinafter the same) chose not to submit the Bid Documents himself but to submit them via a bidding agent any person other than a bidding agent designated in the application for the Bidding registration or any person without the power of attorney and without authority to submit the Bid Documents makes the submission of any of the Bid Documents to PPS on behalf of the Bidder;
5.입찰자의 기명날인 또는 서명이 없는 입찰
5.Bids without signature or seal of bidders;
6.입찰서류의 내용이 입찰통화 등 입찰설명서에서 정한 주요 조건을 반영하지 않고 있거나 또는 입찰설명서에서 정한 서류를 제출하지 아니한 경우
6.the Bid Documents failed to comply with the material requirements set forth in the Bid Invitation such as the designated currency or failed to submit any of the documents required by the Bid Invitation; or
7.입찰서에 기재한 중요부분에 착오가 있음을 이유로 개찰현장에서 입찰자가 입찰의 취소의사를 표시한 것으로서 조달청이 이를 인정한 입찰
7.A Bidder intends to cancel the bid on site on the ground that critical errors have been discovered in major sections in bid, and PPS approves it.
8.그 밖에 입찰공고문에서 정한 입찰 무효 사유가 발생한 경우
8.any other cause for bid invalidation set forth in the bid announcement occurs.
