제19조 재입찰 및 재공고입찰
Article 19 Re-Bid and Bid by Second Public Notice
①조달청은 경쟁입찰에서 2인이상의 유효한 입찰자가 없거나 낙찰자가 없는 경우에는 같은 장소에서 재입찰에 부칠 수 있다. 이 경우에는 최초 입찰에의 참가유무 또는 입찰횟수의 제한을 받지 아니한다
①PPS is entitled to proceed with re-bid in the same place if there are less than two valid Bidders or no successful Bidders. In this case, participation is not restricted by previous participation in the initial bid or number of participations.
②조달청은 다음 각 호의 경우 재공고입찰을 할 권한이 있다. 단, 제4호의 경우에는 조달청은 재공고입찰을 진행하여야 한다.
②PPS has the right to hold a bid by second public notice upon occurrence of one of the following events, provided that PPS shall conduct a bid by second public notice in the case of subclause 4. below:
1.경쟁입찰에서 낙찰자가 없거나 낙찰자가 소정의 기일 내에 계약을 체결하지 아니하는 경우
1.No successful Bidder is selected at the end of the bidding process or the successful Bidder fails to enter into the contract within the period prescribed by PPS;
2.2인 이상의 유효한 입찰자가 없는 경우
2.There are less than two (2) valid Bidders;
3.규격ㆍ가격동시입찰 또는 협상에 의한 계약에서 2인 이상의 유효한 입찰자가 참가하였으나 규격입찰서(제안서)평가 결과 규격적격자가 1인인 경우
3.Two (2) or more valid Bidders participated in a Two-envelope Bidding or the Contract by Negotiation but only one (1) Bidder is determined to be a qualified Bidder following the evaluation of the Specifications Bid(Proposal);
4.2단계경쟁입찰에서 둘 이상의 유효한 입찰자가 참가하였으나 규격입찰서(제안서)평가 결과 규격적격자가 1인인 경우
4.Two (2) or more valid Bidders participated in a Two-stage Bidding but only one (1) Bidder is determined to be a qualified Bidder following the evaluation of the Specifications Bid(Proposal); or,
5.규격적격자가 1인인 경우로서 입찰의 경쟁성, 공정성 등을 확보하기 위하여 조달청이 필요하다고 판단하는 경우
5.There is only one (1) Bidder who satisfies all specifications requirements and PPS determines that a bid by second public notice is necessary to ensure competitiveness and fairness of the bidding.
③재공고입찰서류의 제출
③Submission of the Bid Documents for the Bid by Second Public Notice
1.1차 입찰에 참여하였던 입찰자는 1차 입찰에 제출한 입찰서류로써 재공고입찰서류의 제출에 갈음할 수 있다. 그 경우 제출하지 않은 서류들에 대해 1차 입찰시 제출한 서류와 동일하다는 취지를 서면으로 조달청에게 통지하여야 한다. 전문에 불구하고 재공고입찰의 가격입찰서는 새로 제출하여야 한다.
1.The Bidders who participated in the first bidding may substitute the Bid Documents to be submitted for the bid by second public notice with those submitted for the first bidding. In such instance, the Bidder shall notify PPS in writing that the unsubmitted documents are the same as those already submitted for the first bidding. Notwithstanding the foregoing, the price bid for the bid by second public notice shall be newly submitted.
2.1차 입찰에 참가하였던 입찰자는 1차 입찰 시 제공한 입찰보증금으로 재공고입찰 보증금의 제공에 갈음할 수 있다. 그 경우 입찰자는 보증금액, 유효기한 등 재공고입찰 입찰설명서에서 정한 입찰보증금 요건에 부합하도록 유의하여야 한다.
2.The Bidders who participated in the first bidding may substitute the bid bond for the bid by second public notice with the bid bond provided for in the first bidding. In such instance, the Bidder shall ensure that the bid bond previously provided satisfy the requirements for the bid bond set forth in the Bid Invitation for the bid by second public notice, such as the bond amount and validity period.
