제2조 용어의 정의
Article 2 Definitions
이 입찰유의서에서 사용하는 용어와 약어는 다음과 같은 의미를 가지며, 이 입찰유의서에서 달리 정의되지 않은 용어와 약어는 국제상업회의소가 발표한 인코텀즈(입찰공고일 기준으로 가장 최근에 발효된 것을 의미함. 이하 같음) 및 외자계약일반조건(이하 "계약일반조건"이라 한다)에서 정의한 의미를 가진다.
The terms and abbreviations used in this ITB shall have the following meanings. Terms and abbreviations not otherwise defined herein shall have the meanings ascribed to such terms in the Incoterms (the most recent version as of the bidding announcement date) published by the International Chamber of Commerce ( "ICC") and the General Provisions for Foreign Contract ("GP").
①"정부"는 대한민국 정부를 의미한다.
①"Government" means the government of the Republic of Korea.
②‘조달청’은 대한민국 정부의 조달청을 의미한다.
②"PPS" means the Public Procurement Service of the Republic of Korea.
③"수요기관"은 계약물품을 실제로 사용하는 공공기관 등을 의미한다.
③"End User" means any public organization that actually uses the contracted Goods.
④"입찰자"는 입찰에 참가하는 국내외 개인 또는 단체로서, 입찰설명서에 규정된 사항에 따라 입찰서류를 준비하고 제출하는 자를 의미한다.
④"Bidder" means an individual or organization intending to participate in bids, whether domestic or foreign, who prepares and submits the Bid Documents in accordance with the Bid Invitation.
⑤"공급자"는 계약물품을 계약에 따라 실제로 수요기관에 공급하는 개인 또는 단체를 의미한다.
⑤"Supplier" means any person or organization who actually supplies the contracted Goods pursuant to the contract.
⑥"계약상대자"는 조달청과 계약을 체결한, 입찰자와 공급자 양자를 의미한다.
⑥"Contracting Party" means the Bidder and the Supplier, collectively, who have entered into contract with PPS.

⑧"협상에 의한 계약"은 계약이행의 전문성ㆍ기술성 등의 이유로 필요하다고 인정되는 경우 다수의 입찰자들로부터 입찰서류를 제출 받아 평가한 후 협상절차를 통하여 국가에 가장 유리하다고 인정되는 자와 계약을 체결하는 방식을 의미한다.
⑧"Contract by Negotiation" means the process to be conducted if and when it is determined that expertise and/or technology will be required for proper performance of the contract, during which process the contract is awarded to one of the Bidders through a negotiation process after he is determined to have submitted a bid with terms that are most favorable to the Government, upon evaluation of the Bid Documents submitted by multiple Bidders.
⑨"2단계 입찰"이란 「국가를 당사자로 하는 계약에 관한 법률 시행령」 제18조 제1항 및 제2항 또는 「지방자치단체를 당사자로 하는 계약에 관한 법률 시행령」 제18조 제1항 및 제2항에 따라 지정하는 일시에 먼저 규격입찰을 실시하여 그 결과 적격자로 확정된 2인 이상을 대상으로 가격입찰을 실시하는 입찰방식을 의미한다.
⑨"Two-Stage Bidding" is comprised of two bidding processes in accordance with Article 18

②of the Enforcement Decree of the Act on Contracts to Which the State is a Party, or Article 18

②of the Enforcement Decree of the Act on Contracts to Which a Local Government is a Party. First stage involves a screening process for specifications, and subsequently a second bidding for price is implemented targeting at least two qualified Bidders from the first stage.
⑩"규격가격동시입찰"이란 「국가를 당사자로 하는 계약에 관한 법률 시행령」 제18조제3항 또는 「지방자치단체를 당사자로 하는 계약에 관한 법률 시행령」 제18조제3항에 따라 규격입찰서와 가격입찰서를 별도로 작성하여 각각 별개봉투에 넣어 봉한 후 지정하는 일시에 동시 제출토록 하여 먼저 규격을 심사한 결과 적격자로 확정된 자를 대상으로 가격개찰을 실시하는 입찰방식을 의미한다.
⑩"Two-Envelope Bidding" refers to a bidding method pursuant to Article 18
③of the Enforcement Decree of the Act on Contracts to Which the State is a Party or Article 18
③of the Enforcement Decree of the Act on Contracts to Which a Local Government is a Party. Bid documents for specifications and price are sealed in two separate envelopes and are simultaneously submitted. In evaluation, an envelope with specifications is first reviewed and qualified bidders with specifications are eligible for the price screening.
⑪"입찰설명서"는 입찰참가자격, 입찰서류의 작성, 입찰참가절차, 낙찰자 선정기준 등 입찰 참가시 입찰자들이 알아야 할 사항 및 계약의 조건을 설명하기 위하여 조달청이 작성하여 공고하는 문서를 의미한다.
⑪"Bid Invitation" means documents prepared and publically announced by PPS, explaining (i) the guidance to the bidding process such as the qualification for the bid, preparation of the Bid Documents, procedures for the bid, and awarding criteria and (ii) the terms and conditions of the contract.
⑫"입찰부속서류"는 제8조 제2항에 규정된 서류를 의미한다.
⑫"Supplementary Bid Documents" means the documents specified in Article 8
②hereof.
⑬"규격입찰서(제안서)"는 최저가 입찰, 규격ㆍ가격동시입찰, 2단계경쟁입찰, 협상에 의한 계약시 제출되는 규격 관련 입찰서류를 의미한다.
⑬"Specifications Bid(Proposal)" means documents related to the technical specifications to be submitted as the Bid Documents for lowest price tender, Two-envelope Bidding, Two-stage Bidding, or Contract by Negotiation.
⑭"물품"은 부품, 부속품, 구성품, 예비부품을 포함한 원자재, 물건, 상품, 장비, 공급품 등과 그 설치, 교육, 관리 및 보수 등과 같이 이에 관련한 서비스를 의미한다.
⑭"Goods" means any raw materials, properties, products, equipment and supplies including, inter alia, any parts, ancillary parts, components and spare parts, and services related thereto, including, any installation, training, maintenance and repairs.
⑮"KONEPS"는 조달청이 운영하는 공공기관 물자구매, 시설공사 계약 입찰 통합시스템인 국가종합전자조달시스템(Korea On-line E-Procurement System, 나라장터)을 의미한다.
⑮"KONEPS" means Korea On-line E-Procurement System (Narajangtuh in Korean), the bidding and contracting system for public procurement of goods, services and construction works, operated by PPS.
<16> "인도조건"은 DTE조건(수요기관 지정장소 인도조건) 또는 인코텀즈에 규정된 조건을 의미한다.
<16> "Delivery Terms" means (i) DTE Terms (Delivered to End User) or (ii) other delivery terms set forth in the Incoterms.
<17> "DTE조건"(수요기관 지정장소 인도조건)은 공급자가 물품을 국내에서 공급하는 경우 적용되는 인도조건으로, 이 인도조건 하에서 계약상대자는 수요기관이 지정한 장소까지 계약물품을 운반하고 설치하여야 하는 책임을 지며, 운송ㆍ설치ㆍ시운전 등에 소요되는 모든 비용을 포함한 가격과 위험들을 부담한다.
<17> "DTE Terms" (Delivered to End User) means the Delivery Terms that will be applicable if the Supplier supplies Goods from Korea, where the Contracting Party is responsible for (i) transporting the contracted Goods to the destination designated by the End User and installing the contracted Goods, and (ii) all costs and risks related to the transportation, installation and test operations.
<18> "영업일"은 대한민국 정부부처가 근무하는 날(토요일, 일요일 및 공휴일을 제외한다)을 의미하고, "은행영업일"은 입찰설명서에서 정한 은행이 근무하는 날(토요일, 일요일 및 공휴일을 제외한다)을 의미한다.
<18> "Business Day" means a day on which the government of Korea is open for business, excluding Saturdays, Sundays and public holidays, and "Banking Business Day" shall mean a day on which the bank designated by the Bid Invitation is open for business, excluding Saturdays, Sundays, and public holidays.
