제22조 낙찰자 선정

Article 22 Selection of the Successful Bidder

조달청은 2인 이상의 유효한 입찰자가 참가하여 경쟁이 성립하였다면 적격입찰자 중 충분한 계약이행 능력이 있다고 인정되는 자로서, 다음 각 호의 어느 하나에 해당하는 자를 낙찰자로 선정할 수 있다

낙찰자로 결정된 자가 계약 체결 이전에 입찰무효 등 부적격자로 판명되어 낙찰자결정이 취소된 경우, 동 부적격자를 제외하고 2인 이상 유효한 입찰이 성립되어 있는 때에는 차순위자 순으로 필요한 심사 등을 실시하여 낙찰자를 결정한다.

If there is a competition in the bid with two (2) or more validly participating Bidders, PPS may select a Bidder as the successful Bidder among qualified Bidders if such Bidder is recognized to be fully capable of performing the contract and has satisfied one of the following subclauses:

If PPS’ selection of the successful Bidder is cancelled following the discovery of cause or causes of such Bidder’s disqualification, such as invalidation of the bid, PPS shall select the runner-up Bidder as the successful Bidder, provided that even without the disqualified Bidder, competition exists in the bidding with two (2) or more valid Bidders participating.

a. 세부견적서는 세부 구성품별 단가 또는 가격이나 훈련비와 같은 서비스비용 등이 분리 명시되어야 한다.

a. A detailed quotation shall separately quote a unit price or the price for each component, and services charges, such as training fee.

b. 위험물 또는 컨테이너에 적재할 수 없는 산적화물(bulk cargo), 부피가 크거나 길이가 긴 물품 등의 특수화물은 세부견적서에 특수화물임을 표시하고 그 특성 등을 상세하게 명시하여야 한다.

b. Special cargo such as hazardous cargo, bulk cargo which cannot be loaded in containers, or extra-long and large cargo, shall be marked as such and be specified in detail.

c. 국외공급분의 경우 각 품목에 대한 총 중량과 용적을 계산하여 세부견적서에 정확하게 표기하여야 한다.

c. For the overseas supplied Goods, total weight and volume for each item shall be calculated and accurately specified in a detailed quotation.

d. 입찰설명서에서 계약물품 공급시 특수포장을 요구한 경우, 세부견적서에 낙찰예정자가 계약물품 공급시 사용할 특수포장의 세부적인 규격명세를 기재하여야 한다.

d. If the Bid Invitation requires special packaging to be used for the supply of contracted Goods, the Bidder shall specify the detailed specifications of the special packaging to be provided by the Bidder in the detailed quotation.

e. 중량 및 용적을 잘못 기재하거나 누락한 경우 인도시에 발생되는 불이익은 입찰자에게 있다.

e. The Bidder shall bear any and all disadvantages incurred from any misstatement of or omission of the weight and volume in the course of delivery.

낙찰예정자의 입찰가격이 수요기관의 배정 예산 또는 조달청의 목표가격을 초과하거나, 거래실례가격을 초과하는 등의 경우 조달청은 해당 입찰자와 국가에 유리하도록 가격협상을 할 권리를 가진다. 협상이 결렬되는 경우 조달청은 해당 구매 건을 취소할 수 있다.

In the event the bid price of the provisional successful Bidder exceeds the allocated budget of the End-User or the target price of PPS, or the prevailing market price, PPS shall have the right to engage in price negotiations with the relevant Bidder in favor of the Government. PPS shall have the right to cancel the procurement in the event that the negotiation is unsuccessful.
