제23조 신용조사
Article 23 Credit Search Evaluation
①국외 낙찰예정자 또는 국외 공급자(이하 "국외 낙찰예정자 등")는 조달청의 요청에 따라 조달청이 지정한 신용평가사를 통해 신용조사를 받아야 하며, 신용평가보고서를 입찰설명서에서 정한 바에 따라 조달청에게 제출해야 한다.
①Upon request of PPS, an overseas provisional successful Bidder or an overseas Supplier (the "overseas provisional successful Bidder, etc.") shall submit to a credit search to be conducted by a credit rating company designated by PPS, and shall submit the credit evaluation report to PPS in accordance with the Bid Invitation.

1.조달청은 국외 낙찰예정자 등 전원의 신용조사결과가 조달청이 정하는 신용평가기준 이상일 경우 낙찰예정자와 계약을 체결한다. (i) 국외 낙찰예정자 등이 제1항의 신용평가보고서를 제출하지 않거나 (ii) 국외 낙찰예정자 등의 신용등급이 조달청이 정한 기준에 미치지 못하는 경우, 조달청은 국외 낙찰예정자 등의 납품실적을 확인하거나 유보금을 설정하는 등의 조건으로 낙찰예정자와 계약을 체결할 수 있다.
1.PPS shall enter into the contract with the provisional successful Bidder only if the credit evaluation results for all of the overseas provisional successful Bidders, etc. satisfy the standards prescribed by PPS. However, even if (i) the credit evaluation report under clause
①is not submitted in respect of an overseas provisional successful Bidder, etc. or (ii) the credit rating of an overseas provisional successful Bidder, etc. fails to satisfy the standard prescribed by PPS, PPS may enter into the contract with the provisional successful Bidder on the condition that it sets the amount of its retention money or confirm the delivery performance of the overseas provisional successful Bidder, etc.
2.(i) 국외 낙찰예정자 등의 신용등급이 낮아 계약의 체결이 곤란하거나 (ii) 국외 낙찰예정자 등이 조달청이 제시한 납품실적을 충족하지 못하거나 유보금 증액 등의 조건을 거부한 경우, 국외 낙찰예정자 등은 낙찰예정자에서 제외된다.
2.(i) If the contract cannot be entered into due to a low credit rating of the overseas provisional successful Bidder, etc. or (ii) the overseas provisional successful Bidder, etc. has failed to satisfy the delivery performance proposed by PPS, or has refused to accept the condition proposed by PPS to increase the amount of retention money etc., such overseas provisional successful Bidder, etc. shall no longer be a provisional successful Bidder.
