제24조 낙찰자 결정
Article 24 Confirmation of the Successful Bidder
①낙찰결과의 통보
낙찰결과는 낙찰자에게 전자적으로 통보된다. 다만, 국외입찰자가 직접 또는 우편으로 입찰한 경우는 우편 또는 팩스로 통보할 수 있다.
①Award Notice
Results of bidding shall be notified to the successful Bidder electronically, provided that in the event of an overseas Bidder bidding in person or by mail, such results may be notified by mail or fax.
②낙찰자 공개
조달청은 낙찰자를 결정한 경우, 다음 각 호의 사항을 KONEPS에 공개한다.
1.낙찰된 물품ㆍ수량 및 금액
2.낙찰자 및 공급자의 성명 또는 상호
②Disclosure of the Successful Bidder
PPS shall disclose the following matters on KONEPS following selection of the successful Bidder:
1.The Goods and the quantity and price thereof; and
2.Names of the successful Bidder and Supplier.
③계약보증금의 납부
③Deposit of Performance Bond
1.낙찰자 또는 공급자는 계약금액의 100분의 10 이상에 해당하는 계약보증금을 계약체결 이전까지 입찰설명서에서 정한 통화의 현금(체신관서나 「은행법」의 적용을 받는 금융기관이 발행한 자기앞수표 포함)이나 국가를 당사자로 하는 계약에 관한 법률 시행령 제37조 제2항에 규정한 보증서 등으로 납부하여야 한다. 단, 계약보증금의 유효기간은 조달청이 통보한 기간보다 짧아서는 아니 된다.
1.Prior to execution of the contract, the successful Bidder or the Supplier shall deposit a performance bond in the amount of 10% or more of the contract price, in cash and in the currency designated in the Bid Invitation (including checks issued by the Post Office or a financial institution subject to the Banking Act) or a guarantee specified in Article 37
②of the Enforcement Decree of the Act on Contracts to which the State is a Party, and the validity period of such performance bond shall not be shorter than the period notified by PPS.
2.제1호에 불구하고, 국외 계약상대자의 경우에는 조달청이 정하는 바에 따라 계약보증금을 계약체결 후에 납부하게 할 수 있다.
2.Notwithstanding subclause 1. above, in case of an overseas Contracting Party, the performance bond may be made to deposit after execution of the contract as designated by PPS.
3.제2호에 의거하여, 공급자가 계약보증금을 납부하는 조건으로 계약체결한 경우, 공급자가 계약보증금을 납부하지 아니한 때 낙찰자는 계약보증금 납부에 대한 의무가 면책되지 않는다.
3.In case a Supplier entered into the contract with PPS on the condition that a Supplier may deposit the performance bond pursuant to subclause 2. above, a Successful Bidder shall not be exempted its responsibility for depositing the performance bond if the Supplier fails to deposit the performance bond.
