제25조 계약의 체결
Article 25 Execution of the Contract
①입찰설명서에서 달리 정하고 있는 경우를 제외하고, 낙찰자는 낙찰 통보를 받은 이후 신속히 조달청과 계약을 체결하여야 한다.
①Unless otherwise provided in the Bid Invitation, the successful Bidder shall enter into the contract with PPS without delay upon receiving award notice.
②계약서류의 구성과 우선순위는 계약일반조건 제5조가 적용된다.
②Composition of the Contract documents and priorities thereof shall be as stipulated under Article 5 of the GP.
③낙찰자는 계약보증금 및 인지세를 납부한 후 조달청이 송부한 계약의 초안에 서명하여 조달청에 송부하여야 한다. 계약은 조달청이 낙찰자에 대한 계약체결 통보를 함으로써 그 효력이 발생한다. 단, 국외 입찰자 중 낙찰자가 결정된 경우에는 계약서 서면에 상호 서명하는 방법으로 계약을 체결한다.
③The successful Bidder shall, following the deposit of the performance bond and payment of stamp duty, sign the draft of the contract sent by PPS and deliver the signed original back to PPS. The contract shall become effective by PPS’ notice to the successful Bidder of the execution of the contract, provided that if the successful Bidder is an overseas Bidder, the contract shall become effective when both parties have mutually signed the contract.
④기타 계약체결과 관련한 사항은 계약일반조건에 따른다.
④All other matters relevant to execution the contract shall be governed by the GP.
