제28조 계약금액의 지급
Article 28 Payment of Contract Price
①계약금액의 지급
계약금액의 지급은 계약일반조건에 따른다.

The contract price shall be paid in accordance with the GP.

②Settlement of Ancillary Expenses
1.조달청 또는 수요기관은 선하증권, 보험증권, 영수증 등 관련 증거서류에 근거하여 해당 거래의 인도조건에 따른 정확한 계약금액을 계산하고, 계약에서 정하는 바에 따라 공급자에게 계약금액을 지급한다. 위 계약금액은 공급자가 부담한 실비를 기준으로 하며, 아래 비용이 포함된다.
a. 항공 또는 선박운송비
b. 보험료
c. 관세 및 부가가치세를 포함한 세금
d. 내륙운송료, 창고료, 물자조작료, 통관비용, 기타 국내 비용
1.PPS or the End User shall calculate the accurate contract price for the relevant transaction in accordance with the Delivery Terms, based on supporting documents such as a bill of lading, insurance policy and receipt, and shall pay the contract price to the Supplier in accordance with the contract. The said contract price shall be based on the actual expenses incurred by the Supplier and shall include the following expenses:
a. air or marine transportation costs;
b. insurance premium;
c. taxes, including, inter alia, customs duties and VAT; and
d. inland transportation costs, warehouse fees, handling charges, expenses related to customs clearance, and other domestic expenses.
2.조달청 또는 수요기관은 상기 관련 증거서류에 의한 비용이 계약서상 합의된 비용을 초과하는 경우 초과 금액을 지급하지 않는다.
2.Where the expenses based on the aforementioned supporting documents exceed the amount of expenses agreed in the contract, PPS or the End User shall not pay the excess amount.
3.공급자는 실제 발생된 운송료나 보험료가 명시된 항공 또는 선박 선하증권, 보험증권과 실제 지불된 관세나 부가가치세 및 비용의 영수증을 조달청과 관계은행 및 수요기관에 제시해야 한다.
3.The Supplier shall present to PPS, relevant banks and the End User the air or marine transportation bill of lading specifying the actual transportation costs, insurance policies, and the receipts for customs duties, VAT and expenses actually paid.
③DDP에서 계약상대자의 의무
③Contracting Party’s responsibility with respect to the contracts in DDP Delivery Terms
1.통관과 관련하여 한국정부로부터 부과되는 모든 수입 관세와 세금은 계약상대자가 부담하여야 한다.
1.With respect to customs clearance, all import duties and taxes imposed by the Government on the Goods shall be borne by the Contracting Party.
2.계약상대자는 자기 책임하에 통관을 수행하여야 한다.
2.The Contracting Party shall carry out the customs clearance under its responsibility.
④부족품 또는 부적합품 교체비용
④Expenses for the Replacement of Deficient or Unsuitable Goods
1.부족,부적합 또는 기타 결함이 있는 물품이 공급된 경우 계약일반조건의 규정에 따른다
1.If any deficient, unsuitable, or defective Goods are supplied, such Goods shall be treated and handled in accordance with the GP.
2.공급자가 부족, 부적합 또는 기타 결함 등으로 인하여 계약물품을 재공급하거나 교체하는 경우 계약상대자는 물자조작료, 운송료, 관세 등의 모든 추가비용에 대하여 연대책임이 있다.
2.If the Supplier re-supplies or replaces the contracted Goods due to deficiency, unsuitablility or other defects, the Contracting Party shall be jointly and severally liable for all additional expenses such as handling charges, transportation costs and customs duties.
3.조달청은 계약일반조건에서 정하고 있는 요율을 적용하여 지체상금을 부과할 수 있다. 그러나 교체품이나 부족 품목이 장비나 시스템의 운행에 중요한 부분이고 또 지체선적이 장비나 시스템 사용의 지연을 초래한다면, 지체상금은 계약물품의 전체 금액에 대하여 계산된다.
3.PPS may impose liquidated damages for delay at the rate set forth in the GP. However, if any of the replacements or the deficient Goods are material parts for the operation of the equipment or system of the contracted Goods, and the delay in shipment would cause delay in the use of the equipment or system, the liquidated damages for delay shall be calculated based on the full price of the contracted Goods.
⑤형식승인 또는 검정비용
물품이 대한민국 규정에 의거하여 형식승인 또는 공식 검정을 받아야 하는 경우 계약상대자는 한국정부로부터 형식승인 또는 공식 검정을 받아야 하며, 그와 관련하여 발생하는 모든 비용은 계약상대자가 연대하여 부담한다.
⑤Expenses for Type Approval or Inspection
If the type approval or official inspection is required for the Goods pursuant to laws and regulations of Korea, the Contracting Party shall obtain the type approval or ensure that official inspection is conducted by the Government and the Contracting Party shall jointly and severally bear all relevant expenses.
⑥유보금
다음 각 호의 어느 하나에 해당하는 경우로서 수요기관에서 유보금 설정을 요구한 때 또는 기타 필요에 의해 유보금을 설정한 경우에는 조달청은 총 계약금액의 100분의 10 이상에 해당하는 금액의 지급을 유보하고, 성공적 설치 완료 또는 기타 유보금 지급 조건이 충족되었다는 수요기관의 통보가 있은 후에 공급자에게 계약금액을 지급한다.
⑥Retention Money
If the End User requires retention money or retention money is required by any other necessities for the reasons provided in any of the subclauses below, PPS shall retain the payment of 10% or more of the total contract price, and shall pay the retained amount to the Supplier upon the End User’s notice that installation of the contracted Goods or other conditions for payment of the retention money have been satisfied:
1.계약물품이 설치작업이 필수적으로 요구되는 장비인 경우
1.installation of the equipment is essential;
2.시운전까지 마치는 조건으로 계약한 장비인 경우
2.the equipment is purchased upon completion of test operations;
3.한국철도공사, 지하철공사 등 철도전동차용 자재인 경우
3.the equipment for railway or subway is being supplied to the Korea Railroad Corporation, Rapid Transit Corporation, etc.;
4.항공, 선박, 소방, 구조장비 등 국민의 생명과 안전에 중대한 영향을 미치는 품목에 해당하는 경우
4.the equipment has material effect on the lives and safety of people such as equipment for aircraft, ships, fire safety or rescue; or
5.계약물품이 고가의 장비인 경우
5.the contracted Goods is of high value.
⑦국외 발생 수수료 등의 부담
대한민국 외에서 발생한 모든 은행수수료, 우편료와 그 밖의 비용, 관련 보증금의 납부에 따른 비용 등은 공급자가 부담한다.
⑦Overseas Expenses
The Supplier shall bear any and all bank commissions, postal and other expenses, and costs arising from or in connection with deposit of the relevant bonds, that have been incurred outside of Korea.
