제33조 리스계약
Article 33 Lease Contract
조달청이 외자물품을 리스하기 위해 진행하는 입찰의 경우에는 다음과 같은 사항에 유의하여야 한다. 그 이외 리스계약과 관련한 사항은 시설대여(리스)일반조건에서 정한 바에 따른다.
The Bidder shall take note that the following terms shall apply if a bidding is conducted by PPS for the purpose of leasing foreign Goods ("lease contract"). To any other matters related to the lease contract that are not specifically discussed herein, the General Terms for the Lease Contracts shall apply.
①조달청은 물품에 대한 계약을 체결한 후 리스를 위한 입찰공고를 KONEPS에 게재한다.
①After entering into the contract for the Goods, PPS shall post the bidding announcement for the lease contract on KONEPS.
②물품 계약에 따라 계약상대자가 받아야 할 계약금액은 조달청이 제1항에 따라 실행하는 입찰 결과 조달청과 리스계약을 맺은 리스회사에서 지급한다.
②The contract price payable to the Contracting Party pursuant to the Contract for the Goods shall be paid by the leasing company which will enter into the lease contract with PPS following PPS’ bidding conducted in accordance with clause
①above.
③제1항의 입찰 절차로 인하여 리스계약이 지연됨에 따라 물품에 대한 계약금액의 지급이 지연되더라도 조달청과 수요기관은 이에 대해 책임지지 않는다.
③PPS and the End User shall not be held responsible for any delay in payment of the contract price for the Goods that resulted from a delay in the execution of the lease contract, and bidding procedures described under clause
①above.
④리스계약이 상당 기간 동안 체결되지 않는다면 물품에 대한 계약은 해제될 수 있다.
④The contract for the Goods may be terminated if the lease contract is not entered into by the relevant parties in due course of time.
⑤물품 계약상대자의 잘못으로 물품의 설치가 지연되는 등의 경우 그 기간 동안 발생한 리스이자는 계약상대자가 연대하여 부담한다.
⑤If the installation of the Goods is delayed due to a fault of the Contracting Party of the contract for the Goods, such Contracting Party shall be jointly and severally liable for the interest accrued under the lease contract during the period of delay.
