제39조 다른 법률 등과의 관계
Article 39 Relationship with Other Relevant Legislations, etc.
①입찰공고문 등에서 달리 정하는 경우를 제외하고는 입찰 및 계약에 대해 이 입찰유의서가 적용된다.
①Unless otherwise provided in the bidding announcement, this ITB shall apply to any and all matters related to the bidding and/or the contract.
②이 입찰유의서가 정하지 않은 사항은 다음 각 호의 법령, 규정 및 국제 상관례에 따른다.
1.국가를 당사자로 하는 계약에 관한 법률 또는 지방자치단체를 당사자로 하는 계약에 관한 법률 및 같은 법 시행령ㆍ시행규칙
2.특정조달을 위한 국가를 당사자로 하는 계약에 관한 법률 시행령 특례규정 및 특정조달을 위한 국가를 당사자로 하는 계약에 관한 법률 시행 특례규칙
3.특정물품 등의 조달에 관한 국가를 당사자로 하는 계약에 관한 법률 시행령 특례규정 및 특정물품 등의 조달에 관한 국가를 당사자로 하는 계약에 관한 법률 시행 특례규칙
4.조달사업에 관한 법률 및 같은 법 시행령ㆍ시행규칙
5.조달청 외자입찰서 평가업무 처리규정

②Matters not addressed in this ITB shall be governed by the following laws, regulations and international commercial customs and practices.
1.Act on Contracts to which the State is a Party or the Act on Contracts to which a Local Government is a Party and its Enforcement Decree, and the respective Enforcement Decrees and regulations thereunder
2.Enforcement Decree of the Act on Contracts to which the State is a Party for Specific Procurement and Enforcement Regulations of the Act on Contracts to which the State is a Party for Specific Procurement
3.Enforcement Decree of the Act on Contracts to which the State is a Party for Procurement of Specific Goods, etc. and the Enforcement Regulations of the Act on Contracts to which the State is a Party for Procurement of Specific Goods, etc.
4.Government Procurement Act, and its Enforcement Decree, and the respective Enforcement Decrees and regulations thereunder
5.Foreign Goods Bid Evaluation Regulations of PPS
6.GP
