제6조 입찰자 및 공급자의 책임
Article 6 Responsibilities of the Bidder and the Supplier
①입찰자는 입찰서류 제출마감일까지 입찰공고문의 내용 및 그 변경 사항을 확인하고, 입찰설명서에 있는 모든 유의사항, 양식, 조건 및 규격 등을 충분히 숙지할 책임이 있다.
①The Bidder shall be responsible for being informed and having full knowledge of the contents of the bidding announcement and any amendment thereto and shall familiarize itself with and understand all instructions, forms, terms, conditions, and specifications mentioned in the Bid Invitation, prior to the due date for submission of the Bid Documents.
②입찰자는 입찰서류를 제출함으로써 입찰설명서의 내용을 승낙한 것으로 간주되며, 입찰자는 입찰설명서의 내용 및 입찰자가 제출한 입찰서류의 내용에 구속된다. 입찰자가 입찰설명서의 내용 모두 또는 일부를 승낙하지 않음을 입찰서류에 명시한 경우 조달청은 당해 입찰서류를 평가에서 제외한다.
②By submitting the Bid Documents, the Bidder shall be deemed to have agreed to the terms and conditions of the Bid Invitation and the Bidder shall be bound by the terms and conditions of the Bid Invitation and any Bid Documents submitted by the Bidder. The fact that the Bidder has expressed its intention to reject whole or part of the Bid Invitation shall be excluded from evaluation of the Bid Documents.
③공급자는 공급자증명서를 제출함으로써 입찰설명서 및 입찰서류의 내용을 모두 숙지하고 있고, 입찰자가 낙찰자로 선정되는 경우 공급자도 입찰설명서 및 입찰서류의 내용에 구속되는 것에 동의한 것으로 간주된다. 공급자는 입찰설명서 및 계약의 내용에 따라 입찰자와 연대하여 계약을 이행할 책임이 있다.
③By submitting the Supplier’s Certificate, the Supplier agrees and acknowledges that the Supplier fully understands (i) the terms and conditions of the Bid Invitation and the Bid Documents and (ii) the fact that the Supplier will be bound by the terms and conditions of the Bid Invitation if the Bidder is selected as the successful Bidder. The Supplier shall be jointly responsible with the Bidder for the performance under the contract in accordance with the Bid Invitation and the contract.
④입찰자는 공급자에게 제3항에서 정한 공급자의 책임을 설명할 의무가 있다.
④The Bidder shall fully explain the Supplier’s responsibilities as provided in clause
③to the Supplier.
⑤입찰자는 본 조에 따른 의무를 이행하여야 하며, 공급자가 계약상대자로서의 책임을 다하지 아니하는 경우에도 공급자와 연대하여 계약불이행에 대한 책임을 진다.
⑤The Bidder may perform its obligations pursuant to this Article 6, and if the Supplier also fails to perform its obligations as a Contracting Party, the Bidder and the Supplier shall jointly and severally be liable for any such non-performance of the contract.
