제9조 입찰서류 작성
Article 9 Preparation of Bid Documents
입찰자는 입찰설명서상의 도면, 규격 및 입찰설명서에 기술된 일정, 절차 등 모든 유의사항을 숙지하고, 합리적 주의를 기울여 입찰설명서에서 요구하는 바에 따라 입찰서류를 작성하여야 한다. 입찰설명서의 내용을 양지하지 아니하여 발생하는 불이익 및 입찰서류 등의 기재오류로 인하여 발생하는 불이익은 입찰자가 부담한다.
The Bidder shall fully understand all instructions in the Bid Invitation, including, inter alia, the drawings and specifications required under the Bid Invitation and the procedures and schedules explained in the Bid Invitation, and shall prepare the Bid Documents with reasonable care, as instructed in the Bid Invitation. The Bidder shall be responsible for any and all disadvantages arising from insufficient understanding of the Bid Invitation or any error it makes in preparing any of the Bid Documents.
①전자입찰의 경우, 입찰자는 KONEPS에서 별지 제2호 외자구매입찰서(전산서식)에 따른 입찰 내용을 입력하는 방법으로 가격입찰서를 작성하여야 한다.
①For electronic bidding, the Bidder shall prepare the price bid by completing and submitting the form of Bid Application (Electronic Form) (Appendix 2) electronically through KONEPS.
②직접 또는 우편입찰의 경우, 입찰자와 공급자는 별지 제2-1호 외자구매입찰서, 별지 제2-2호 견적서 및 별지 제2-3호 물품명세서 서식을 각각 작성하고, 입찰자와 공급자를 대표할 수 있는 법적 권한이 있는 자가 각각 서명 또는 기명날인하여 제출하여야 한다.
②For submission of the bid in person or by mail, the Bidder and the Supplier shall prepare and submit the Bid Application, Price Quotation and Goods Description in the form of Appendix 2-1, Appendix 2-2 and Appendix 2-3, respectively, with seal or signature by a person or persons who are duly authorized to represent the Bidder and the Supplier, respectively.
③규격ㆍ가격동시입찰, 협상에 의한 계약 또는 2단계경쟁입찰의 경우는 규격입찰서(제안서)와 가격입찰서를 다음 각 호에 따라 각각 별도로 준비하여야 한다.
1.규격입찰서(제안서)에는 입찰자가 제안하는 물품이나 서비스에 대한 규격을 상세히 기술하고, 물품이나 서비스가 입찰설명서의 요구사항에 부합하다는 것을 입증하는 서류들을 첨부하여야 한다. 규격입찰서(제안서)의 표지는 별지 제6호 서식을 사용하여야 한다.
2.가격입찰서는 별지 제2-1호, 제2-2호 및 제2-3호 서식에 의해 작성되어야 하며, 입찰자와 공급자를 대표할 수 있는 법적 권한이 있는 자가 각각 서명 또는 기명날인하여야 한다.
③For Two-envelope Bidding, Contract by Negotiation and Two-stage Bidding, the Specifications Bid(Proposal) and the price bid shall be prepared separately in accordance with the following:
1.The Specifications Bid(Proposal) shall include the proposed specifications for the Goods or services so proposed by the Bidder, and documents showing that the Goods or services proposed satisfy the requirements set forth in the Bid Invitation. The cover page for the Specifications Bid(Proposal) shall be in the form set out in Appendix 6.
2.The price bid shall be prepared in the form set out in Appendices 2-1, 2-2 and 2-3, and shall be either (x) signed or (y) name printed with seal affixed next to it by a person or persons who are duly authorized to represent the Bidder and the Supplier, respectively.
④입찰서류의 내용을 제출 전에 삭제 또는 기타 변경하고자 하는 경우, 그 사유를 명시하거나 주석을 달고 가격입찰서에 서명하는 모든 자 또는 그 서명자로부터 위임 받은 자가 삭제 또는 변경 내용 옆에 서명 또는 이름 첫 자를 기재하여야 한다.
④If the Bidder intends to delete or otherwise modify any of the Bid Documents before submission, the reasons therefor shall be inserted or explained by footnote, and all signatories to the price bid or person(s) duly authorized by such signatories to the Bid Application shall place his/her/their signature(s) or the initial of his/her/their name(s) on the part which is to be deleted or modified.
⑤입찰자는 조달청에 제출한 입찰서류를 변경, 교체, 수정, 철회, 취소 및 보완할 수 없다. 다만 입찰서류에 입찰금액 등 중요한 사항에 오류가 있는 경우, 입찰자는 조달청의 동의를 얻어 개찰일시 이전까지 입찰취소를 할 수 있다. 입찰을 취소하고자 하는 입찰자는 개찰일시 이전까지 별지 제7호 서식의 입찰취소신청서를 작성하여 KONEPS를 통하거나, 직접 또는 팩스로 조달청에 제출하여야 한다. 입찰취소신청서는 가격입찰서에 서명한 모든 자 또는 그 서명자로부터 위임 받은 자가 서명 또는 기명날인하여야 한다.
⑤The Bidder may not modify, exchange, amend, withdraw, cancel or supplement the Bid Documents submitted to PPS; provided, however, if there is an error on a material item, such as the bid price, in Bid Documents, the Bidder may, with consent of PPS, cancel the bid prior to the opening of the bids. A Bidder who intends to cancel the bid shall submit to PPS an Application for Cancellation of the Bid in the form set out in Appendix 7, prior to the bid opening date and time, through KONEPS, in person, or by fax. The Application for Cancellation of the Bid shall be either (x) signed or (y) name printed with seal affixed next to it by all signatories to the price bid or person(s) duly authorized by such signatories to the price bid.
⑥기술규격서에 도면이 첨부된 경우, 그 도면은 오류 또는 모순이 있을 수 있음을 유의하여야 한다. 입찰자는 입찰공고 상의 도면과 서술식 규격서를 비교하고, 입찰공고 상의 도면과 서술식 규격서와의 일치를 위하여 도면의 수정이 필요한 경우 그 수정내용을 입찰서류에 명시하여야 한다.
⑥If the Technical Specifications includes drawings, the Bidder shall be aware that there may be an error or contradiction in a drawing. The Bidder shall compare the drawing with the written specifications in the bidding announcement, and if modification of the drawing is necessary to reflect the written specification, the Bidder shall specify such modifications in the Bid Documents.
