Article 23(LIQUIDATED DAMAGES)
①계약상대자가 지정기일내에 물품을 인도하지 않을 경우, 조달청 또는 수요기관은 아래와 같은 지체상금을 부과한다. : 지정된 인도일로부터 연체 기간 1일당 계약서에서 정한 지체상금률을 계약금액(지정기한내에 계약을 분할 이행한 경우에는 미선적분 금액)에 곱하여 산출한 금액을 지체상금으로 부과한다. 어느 경우라도 조달청은 계약을 해지할 권한을 갖는다.
①If the Contracting Party fails to make delivery of Goods within the due time, PPS or End User shall, at its discretion, impose the following liquidated damages:For each day of delay, fine is imposed as much as rate of the liquidated damages, stipulated in the contract, multiplied by contract value, as liquidated damage (if contract has been partially implemented within the stipulated time, the total value of the unshipped portion thereof). In either case, PPS reserves the right to terminate the contract.
②설치작업이 요구되는 경우, 입찰공고서에 명시된 바와 같이, 모든 설치작업은 지정된 시간에 수요기관의 장소에서 마무리되어져야 한다. 입찰공고서에서 요구된 바와 같이 계약상대자는 용역기간 동안의 시간표와 인력파견 계획표를 제공하여야 한다. 작업완료일이 반드시 명시되어야 한다. 만약 작업이 지정된 기일내에 완료되지 않으면, 연체 기간 1일당 계약서에서 정한 지체상금률을 계약금액에 곱하여 산출한 금액을 지체상금으로 부과한다. 이 경우 선적지연에 대한 부과금(23조
①항)은 적용되지 않는다. 만약 지체 사유가 계약상대자에게 있지 아니하면 동 지체상금은 부과되지 아니한다.
②In case that installation work is required, as stipulated in the bid announcement, all installation work shall be completed at the End User's site within the designated time. The Contracting Party shall submit a time table and dispatching schedule for the period of services as requested in the bid. If the work is not completed within the designated time, the amount calculated by multiplying the rate of liquidated damages stipulated in the contract for one day by the contract amount is imposed as the liquidated damages. In this case the penalty for the delay in delivery [Clause23.a)] shall not be applied. This delay charge shall not apply, if the delay is not the responsibility of the Contracting Party.
③제1항 및 제2항의 경우 기성부분 또는 기납부분에 대하여 검사를 거쳐 이를 인수한 경우(인수하지 아니하고 관리ㆍ사용하고 있는 경우를 포함한다)에는 그 부분에 상당하는 금액을 계약금액에서 공제한 금액을 기준으로 지체상금을 계산하여야 한다. 이 경우 기성부분 또는 기납부분의 인수는 성질상 분할할 수 있는 공사ㆍ물품 또는 용역에 대한 완성부분으로서 인수하는 것에 한한다.
③If a portion already completed or supplied has been accepted through an inspection in cases of paragraphs
①and
②(including portions managed and used without accepting them), the calculation of the damages for delay shall be based on the amount computed by subtracting the amount for such portion from the contract price. In such cases, the acceptance of a portion completed or supplied shall be limited to the acceptance of a completed portion of a construction project, goods, or services, which is divisible in the nature thereof.
④제1항부터 제3항까지에 따라 납부할 지체상금이 계약금액(제3항에 따라 기성부분 또는 기납부분에 대하여 검사를 거쳐 이를 인수한 경우에는 그 부분에 상당하는 금액을 계약금액에서 공제한 금액을 말한다)의 100분의 30을 초과하는 경우에는 100분의 30으로 한다.
④Where the damages for delay to be paid under paragraphs
①through
③exceeds 30/100 of the contract price (where a portion already completed or supplied has been accepted through an inspection pursuant to paragraph
③, referring to the amount computed by subtracting the amount for such portion from the contract price), it shall be 30/100.
⑤계약물자가 수요기관 지정장소도(Delivered to End-user's Site; DTE), 도착지양하인도(Delivered at Place Unloaded), 도착장소인도(Delivered At Place), 관세지급인도(Delivered Duty Paid)조건으로 공급되는 물품, 용역의 지체상금 적용시점은 수요자 최종 인수일을 기준으로 한다.
⑤In the case of Goods or services supplied under the terms of DTE(Delivered to End-user's Site), DPU(Delivered at Place Unloaded), DAP(Delivered At Place) or DDP(Delivered Duty Paid), the liquidated damages shall be calculated on the basis of completion date of contract implementation including installation and test operation.
