Article 10(INSPECTION)
①수요기관은 개별 검정(제3자 검정)이 필요하다고 인정되어 검정을 실시하는 경우, 검정에 대한 일반요건은 다음 각 호와 같다.
①If the End User deems an independent inspection(third-party inspection) necessary and conducts such inspection, the general requirements for the inspection shall be as follows: 1. 개별 검정(제3자 검정)이 필요하다고 생각되는 경우, 수요기관은 계약발효일로부터 적정한 기간내에 계약상대자의 비용으로 물품인도전에 해당 물품을 검정할 검정자를 지정하여야 한다. 계약상대자는 늦어도 인도 20일전에 물품 검정을 위한 준비를 완료하고 이를 검정자에게 통보할 의무가 있다. 1. If independent inspection is deemed necessary, the End User, within a reasonable amount of time from the effective date of the contract shall appoint an inspector to inspect, at the Contracting Party’s expense the Goods prior to delivery. It shall be the Contracting Party’s responsibility to advise the inspector that the Goods is ready for inspection at least twenty(2O) days prior to the delivery. 2. 계약상대자는 검정자가 그 책임과 의무를 제대로 이행할 수 있도록 자체작성 검정기록 등을 포함한 모든 필요한 시설과 지원을 검정자에게 제공하여야 한다. 검정자는 계약상대자로부터 검정준비 완료통보를 받은 때에는 지체 없이 해당 물품에 대한 검정을 실시하고 즉시 검정증명서를 발급하여야 한다. 2. The Contracting Party shall furnish the inspector with all reasonable facilities and assistance, including records of all inspection performance made by the Contracting Party to enable the inspector to fulfill his obligation and responsibilities. Upon receipt of such advice, the inspector shall inspect the Goods without delay and will promptly and immediately issue a certificate of inspection for the Goods. 3. 검정자는 재료나 제조기술에 결함이 있거나 계약요건에 일치하지 않은 것으로 밝혀진 물품에 대하여 거부할 권리가 있다. 검정자가 불합격 판정을 내린 경우, 계약상대자는 불합격품 대신에 새로운 물품을 추가로 제공하여 검정 받을 수 있다. 단 추가물품의 제공은 계약기간내에 이루어져야 한다. 3. The inspector shall have the authority to reject any Goods which are found to be defective in material or workmanship, or otherwise not in conformity with the requirements of the contract. In the event the inspector disapproves any Goods, the Contracting Party may tender additional quantities for inspection and approval in lieu of the Goods disapproved, provided such tender is made during the term of the contract. 4. 검정자가 공급자로부터 검정준비 완료통지를 받은 후 20일내에 검정을 실시하지 못할 경우, 계약상대자는 수요기관의 승인을 받아 해당 물품을 검정할 제3검정자를 자기비용으로 선임할 수 있다. 4. In the event the inspector fails to inspect the Goods within twenty (2O) days after being advised that the Goods is ready for inspection, the Contracting Party shall select, subject to the End User’s approval, an independent inspector to inspect the Goods at the Contracting Party’s expense. 5. 검정자가 계약물품의 일부를 불합격 시켰을 경우, 수요기관의 재량으로 공급물품 전량을 불합격한 것으로 간주하여 거부할 수 있다. 계약상대자는 검정증명서에 기재된 물품과 동일한 물품을 수요기관에 인도할 책임이 있다.5. At the discretion of the End User, the End User has a right to reject the entire quantity if any portion of the total Goods contracted is disapproved by the inspector. The Contracting Party shall be responsible that the Goods delivered to the End User is the same Goods as described in the certificate of inspection.
②계약에 따라 공급되는 물품은 다음 각호의 해당 사항에 대하여 수요기관이 지명한 검정자의 검사와 시험을 받아야 한다.
②Goods to be supplied under the contract shall be inspected and tested by the inspector appointed by the End User as to the following points, if applicable: 1. 공급될 물품제작에 사용된 재료 및 원료의 물리적, 화학적 특성 2. 물품의 구조, 구성 및 조립 등의 제작기술 및 품질 3. 물품의 성능 및 작동시험 4. 중량 및 수량 5. 포장상태 및 표시 6. 기타 계약서상 추가로 명시된 사항들. 1. Physical and chemical properties of materials or elements incorporated 2. Workmanship and quality or construction, fabrication, and assembly of Goods. 3. Performance test and operating test of Goods. 4. Weight and quantity. 5. Packing conditions and markings. 6. Points to be further specified in the contract.
③검정자는 검정을 마친 모든 물품에 검정자 고유의 문장(紋章)을 찍거나, 각인하거나 부착하여야 한다. 물품자체에 문장을 하기가 적합치 않은 경우에는 그 물품을 포장한 용기에 동일한 방법으로 표시하여야 한다. 검정자 표시의 크기는 물품, 포장물 또는 선적용 용기의 크기에 따라 변할 수 있다.
③All Goods inspected under the contract shall be stamped, stenciled or labeled with the inspector's emblem. If it is not practicable to mark the Goods with the inspector's emblem, the containers in which the Goods are packed shall be so marked. The size of the inspector's emblem may vary depending upon the size of the Goods, packages or shipping containers to be marked.
