Article 21(PAYMENT)
①조달청은 계약 체결 후, 한국 내 외국환은행에 취소 및 상환불능 상업신용장의 발급을 신청한다. 계약서상에 별도로 명시되어 있지 않는 한, 신용장은 계약금액 전액을 공급자 앞으로 개설하고, 신용장에 명시된 최종 선적일로부터 1개월간 유효하도록 한다.
①After the contract is made, PPS will apply to an authorized foreign exchange bank in Korea, for issuance of an irrevocable and without recourse; commercial letter of credit. Unless otherwise specified in the contract, the letter of credit shall be established in favor of the supplier in the amount of the total contract value, and shall be maintained for one(1) month after the latest shipping date specified in the letter of credit.
②대금은 다음 각 호의 서류를 첨부한 수익자의 일람불 어음의 제시에 따라 미국달러 또는 기타 계약에서 정한 통화로 지급된다.
②Payment shall be made in U.S Dollars or other currency/ies designated in the contract upon presentation of the beneficiary's sighted draft accompanied by the following documents: 1. 대한민국 조달청을 수화인으로 하고 최종 도착항까지의 해상운임의 선불, 경우에 따라서는 후불 표시를 한 무하자선적 선하증권 또는 용선계약 선하증권 원본 2. 물품명세, 수량, 단가, 총액 및 인도조건을 명시한 수익자의 세부 송장 3. 표시 및/또는 중량명세서를 첨부한 검정서 4. 해당하는 경우, 포장명세서 5. 해당하는 경우, 보험증권 또는 보험가입증명서 6. 기타 필요한 서류 1. A full set of clean onboard ocean vessel or charter party Bills of Lading, marked : "freight prepaid" or "freight collect", as the case may be, to port of destination, consigned to the Public Procurement Service, Government of the Republic of Korea. 2. Beneficiary's detailed invoice showing Goods description, quantity, unit price, total price, and basis of delivery. 3. Inspection certificates with marking certificate and/or weight certificate. 4. Packing lists, if applicable. 5. Insurance policies or certificates, if applicable. 6. Other documents required, if any.
③용역에 대한 대금지급은 계약조건에 따라 조달청의 지시에 의해 이루어진다.
③Payment for services shall be made upon PPS's instructions, in accordance with the contractual terms and conditions.
④그러나 국내에서 공급되는 물품, 용역에 대한 대금은 수요기관이 직접 지급한다.
④However, payment for Goods and services supplied from within Korea shall be directly paid by the End User
⑤계약상대자는 선금을 지급받고자 할 경우 외자구매업무 처리규정 제55조에 따라 그에 대한 보증금을 납부하여야 한다.
⑤In case where the Contracting Party intends to benefit from advance payment, it shall establish a guarantee bond in accordance with Article 55 of the Foreign Goods Purchase Regulations.
