Article 30(FORCE MAJEURE)
①계약상대자는 다음과 같은 경우에는 제23조 (지체상금)에서 규정한 지체상금 및 제29조 (위약)에서 규정한 초과비용 또는 기타 손실을 부담하지 아니하며 또한 계약보증금도 국고에 귀속되지 아니한다.
①The Contracting Party shall not be charged with the liquidated damages prescribed in Section 23. LIQUIDATED DAMAGES and/or any excess costs or any other losses to PPS prescribed in Section 29. DEFAULTS, nor shall his performance bond be forfeited. 1. 계약상대자가 불가항력적인 사유(천재지변, 공공의 적, 계약상대자 또는 주권국의 행정지배, 화재, 홍수, 전염병, 검역통제, 파업, 선박억류, 악천후 등 계약상대자의 자기통제 범위를 벗어나고 예측이 불가능하며 과실이나 태만에 기인하지 않은 불가항력적인 사고)로 계약을 불이행 하는 경우 1. When failure of the Contracting Party in making suitable delivery is due to causes beyond his/her control and which could not reasonably have been anticipated, and were without his/her fault or neglect including, but not restricted to, acts of God or public enemy, acts of the government whether as Contracting Party or sovereign, fires, floods, epidemics, quarantine restrictions, strikes, freight embargoes, and unusually severe weather, and 2. 제13조(하도급계약)의 규정에 따라 계약서에 명시되어 있는 하도급계약자가 위에서 언급된 불가항력적인 사유로 인해 계약이행지체 또는 계약불능의 상태가 됐기 때문일 경우. 2. Delays and failure of a subcontractor due to any of such causes as above, only in case the subcontractor is specified in the contract in compliance with Section 13. SUB-Contract.
②계약상대자가 제1항 각호의 사유 발생일로부터 10일 이내에 또는 계약종결전에 조달청이 별도 허락한 경우 그 연장기한내에 계약불이행의 사유를 조달청에 문서로 통보하면 조달청은 그 사실과 정도를 결정하여야 한다.
②If the Contracting Party notifies PPS in writing of causes of such failure not less than ten(10) days from the beginning prescribed in subparagraphs of paragraph
①or such further period as PPS may grant prior to date of the final settlement of the contract, PPS shall decide the facts and extent of failure.
③관련 당사자는 제31조에서 규정한 바에 따라 제소할 권한을 갖는다는 전제하에 이 결정은 최종적이고 또 결정적인 효력을 갖는다.
③Its decision shall be final and conclusive, subject to the parties hereto holding right to appeal as provided in Article 31.
