Article 31(DISPUTE SETTLEMENT)
①본 계약에 의한 권리의무에 관하여 소송의 필요가 생긴 때에는 소송의 1심 법원은 법이 정하는 관할법원과 아울러 아래에 정한 법원 중 조달청이 선정하는 법원으로 한다.
①When legal proceedings are deemed to be necessary for the rights and obligation in connection with this contract, the First Trial Court for the concerned litigation shall be the court chosen by PPS among the competent courts by the law and one of the following courts: 1. 서울중앙지방법원 1. Seoul Central District Court; 2. 조달청의 본청 소재지 관할법원 2. the Competent Court where the head office of PPS belongs.
②그러나 분쟁당사자간에 합의가 있을 경우, 법원에 가지 아니하고 대신 대한상사중재원의 국제중재 규칙과 대한민국 법에 따른 중재 요청하여 관련 분쟁을 해결할 수도 있고, 국가를 당사자로 하는 계약에 관한 법률 제28조 또는 지방자치단체를 당사자로 하는 계약에 관한 법률 제34조에서 정한 이의신청 대상에 해당하는 경우 국가계약분쟁조정위원회 또는 해당 지방자치단체 및 지방자치단체 계약분쟁조정위원회의 조정결정에 따라 분쟁을 해결할 수 있다.
②However, the dispute may be settled by arbitration in Korea the necessity of court proceedings, in accordance with the International Arbitration Rules of the Korean Commercial Arbitration Board and under the Laws of Korea only if an agreement is made between the parties to the dispute. If cases turn applicable to objection claims under Article 28 of the Act on Contracts to Which the State is a Party or Article 34 of the Act on Contracts to Which a Local Government is a Party, disputes can be settled through arbitration decisions by the State Contract Disputes Conciliation Committee, or the corresponding local government or its dispute conciliation committee.
③제1항 및 제2항에도 불구하고 계약을 체결하는 때에 「국가를 당사자로 하는 계약에 관한 법률」제28조의2에 따라 분쟁해결방법을 정한 경우에는 그에 따른다.
③If any method for dispute settlement is determined, when signing a contract, as stipulated in the Article 28-2 of the Act on Contracts to Which the State is a Party, notwithstanding Paragraph

②, settlement shall be proceeded according to the method.
④계약상대자는 제1항부터 제3항까지의 분쟁처리절차 수행기간중 계약의 수행을 중지하여서는 아니된다.
