Article 6(PERFORMANCE BOND)
①국외입찰자 또는 국외공급자가 계약보증금을 납부하는 경우, 국외입찰자 또는 국외공급자는 계약체결 이전까지 취소불능신용장, 현금, 보증수표 또는 은행보증서의 형태로 계약금액의 10% 이상에 해당하는 금액의 계약보증금을 조달청을 수취인으로 하여 신용장 통지은행에 납부하여야 한다. 다만 조달청은 국외입찰자 또는 국외공급자로 하여금 조달청이 정하는 바에 따라 계약보증금을 계약체결 후에 납부하게 할 수 있다. 계약보증금은 신용장상의 최종선적일(선적일이 연장된 경우는 그 연장된 선적일)로부터 3개월간 유효하여야 한다. 동 계약보증금은 조달청이 입찰자 또는 공급자가 계약조건대로 계약을 이행하지 아니하였다는 내용의 문서를 첨부하여 수령증을 제시하면 계약서상의 통화로 지급될 수 있어야 한다.
①In the case where deposit of the performance bond is a must, the overseas Bidder or overseas Supplier shall pay a performance bond through the advising bank of the letter of credit, before execution of contract, in the form of irrevocable clean credit, cash, certified check or bank guarantee, in favor of PPS in the amount not less than ten percents(10%) of the contract value. However, the performance bond payment can be paid after execution of contract upon permission by PPS. The performance bond shall be valid three(3) months after the latest shipping date or any extension thereof, payable in the currencies of the contract and available for payment against PPS's certificate stating that the Bidder and/or the Supplier has failed to comply with terms and conditions of the contract.
②국내입찰자가 계약보증금을 납부하는 경우, 국내입찰자는 계약금액의 10%이상에 해당하는 계약보증금을 계약체결 이전에 한국 원화로 지급될 수 있는 현금(체신관서나 은행법의 적용을 받는 금융기관이 발행한 자기앞수표 포함)이나, 국가를 당사자로 하는 계약에 관한 법률 시행령 제37조 제2항에 규정된 보증서등으로 조달청에 납부하여야 하며, 국외공급자가 제1항에 따른 계약보증금을 납부하지 아니한 때에는 입찰자는 위 계약보증금 납부에 대하여 연대책임을 진다.
②In the case where a performance bond is paid by a domestic Bidder; the domestic Bidder shall pay a performance bond in favor of PPS, before the conclusion of a contract, in the amount not less than ten percents(10%) of the contract value, in the form of cash (including check issued by the Post Office or a financial institution subject to the Banking Act), or a guarantee specified in Article 37
②of the Enforcement Decree of the Act on Contracts to which the State is a Party, payable in Korean Won, and the Bidder shall jointly take responsibility for paying the performance bond in the case where the overseas Supplier under clause
①fails to pay the performance bond.
③계약보증금은 계약이 만족스럽게 이행된 후 또는 유효기간이 완료되었거나 양자 중 먼저 도래하는 경우에 조달청의 지시에 의해서 반환된다.
③Performance bond shall be returned upon instructions of PPS after satisfactory completion of the contract, or on its expiry date, whichever comes first.
④낙찰자와 공급자는 계약보증금을 나누어 납부할 수 있다.
④Successful Bidder and Suppliers can jointly pay the performance bond.
⑤미화 4만 달러 이하의 계약일 경우, 조달청은 계약보증금 납부를 면제할 수 있다.
⑤In the case where the contract amount is US$40,000(forty thousand dollars) or less, PPS may exempt the Contracting Party from the obligation to pay a performance bond.
